第一章 總 則
Chapter I General Principles
第一條 為了加強安全生產(chǎn)監(jiān)督管理，防止和減少生產(chǎn)安全事故，保障人民群眾生命和財產(chǎn)安全，促進經(jīng)濟發(fā)展，制定本法。
Article 1 The present law has been enacted for the purpose of strengthening the supervision and administration of production safety, preventing and reducing safety accidents, defending the safety of life and property of the masses, and promoting the development of economy.
第二條 在中華人民共和國領(lǐng)域內(nèi)從事生產(chǎn)經(jīng)營活動的單位（以下統(tǒng)稱生產(chǎn)經(jīng)營單位）的安全生產(chǎn)，適用本法；
Article 2 The present law shall be applicable to the production safety of the entities that are engaged in to the production and business operation activities within the territory of the People's Republic of China (hereinafter referred to as the production and business operation entities).
有關(guān)法律、行政法規(guī)對消防安全和道路交通安全、鐵路交通安全、水上交通安全、民用航空安全另有規(guī)定的，適用其規(guī)定。
Where there are different provisions in laws or administrative regulations concerning the safety of fire control, road traffic and transportation, railway transportation, water transportation, civil air transportation, etc., such provisions shall be applied.
第三條 安全生產(chǎn)管理，堅持安全第一、預(yù)防為主的方針。
Article 3 For the administration of production safety, the guidelines of "safety first, focus on prevention" shall be observed.
第四條 生產(chǎn)經(jīng)營單位必須遵守本法和其他有關(guān)安全生產(chǎn)的法律、法規(guī)，加強安全生產(chǎn)管理，建立、健全安全生產(chǎn)責(zé)任制度，完善安全生產(chǎn)條件，確保安全生產(chǎn)。
Article 4 The production and business operation entities shall observe the present law and other relevant laws, regulations concerning the production safety, strengthen the administration of production safety, establish and perfect the system of responsibility for production safety, perfect the conditions for safe production, and ensure the safety in production.
第五條 生產(chǎn)經(jīng)營單位的主要負責(zé)人對本單位的安全生產(chǎn)工作全面負責(zé)。
Article 5 The major person-in-charge of the production and business operation entities shall take charge of the overall work of the production safety of the entity concerned.
第六條 生產(chǎn)經(jīng)營單位的從業(yè)人員有依法獲得安全生產(chǎn)保障的權(quán)利，并應(yīng)當(dāng)依法履行安全生產(chǎn)方面的義務(wù)。
Article 6 The employees of the production and business operation entities have the right to production safety according to law, and shall also be obliged to perform their obligations regarding to production safety.
第七條 工會依法組織職工參加本單位安全生產(chǎn)工作的民主管理和民主監(jiān)督，維護職工在安全生產(chǎn)方面的合法權(quán)益。
Article 7 The trade unions shall organizes the workers to participate in the democratic management and supervision of the production safety of the entity where they work so as to safeguard the lawful rights and interests of the workers in production safety.
第八條 國務(wù)院和地方各級人民政府應(yīng)當(dāng)加強對安全生產(chǎn)工作的領(lǐng)導(dǎo)，支持、督促各有關(guān)部門依法履行安全生產(chǎn)監(jiān)督管理職責(zé)。
Article 8 The State Council and the people's governments at all levels shall strengthen the leadership over the work of production safety, and support and urge the relevant departments to perform their respective duties of supervision and administration of production safety.
縣級以上人民政府對安全生產(chǎn)監(jiān)督管理中存在的重大問題應(yīng)當(dāng)及時予以協(xié)調(diào)、解決。
The people's governments on the county level and above shall coordinate and handle the serious problems that exist in the supervision and administration of production safety in good time.
第九條 國務(wù)院負責(zé)安全生產(chǎn)監(jiān)督管理的部門依照本法，對全國安全生產(chǎn)工作實施綜合監(jiān)督管理；
Article 9 The department of the State Council in charge of the supervision and administration of production safety implements comprehensive supervision and administration of the work of production safety of the whole country.
縣級以上地方各級人民政府負責(zé)安全生產(chǎn)監(jiān)督管理的部門依照本法，對本行政區(qū)域內(nèi)安全生產(chǎn)工作實施綜合監(jiān)督管理。
The people's governments on the county level and above in charge the supervision and administration of production safety shall implement comprehensive supervision and administration of the work of production safety with their respective administrative jurisdictions according to the present law.
國務(wù)院有關(guān)部門依照本法和其他有關(guān)法律、行政法規(guī)的規(guī)定，在各自的職責(zé)范圍內(nèi)對有關(guān)的安全生產(chǎn)工作實施監(jiān)督管理；
The relevant departments of the State Council shall, according to the provisions of the present law and other relevant laws and administrative regulations, implement supervision and administration of the work of production safety within their respective functions and duties.
縣級以上地方各級人民政府有關(guān)部門依照本法和其他有關(guān)法律、法規(guī)的規(guī)定，在各自的職責(zé)范圍內(nèi)對有關(guān)的安全生產(chǎn)工作實施監(jiān)督管理。
The relevant departments of the people's governments on the county level and above shall, according to the provisions of the present law and other relevant laws and regulations, implement supervision and administration of the work of production safety within their respective functions and duties.
第十條 國務(wù)院有關(guān)部門應(yīng)當(dāng)按照保障安全生產(chǎn)的要求，依法及時制定有關(guān)的國家標準或者行業(yè)標準，并根據(jù)科技進步和經(jīng)濟發(fā)展適時修訂。
Article 10 The relevant departments of the State Council shall, according to the requirements of guaranteeing production safety, formulate relevant national standards or industrial standards according to law and in good time, and shall make revisions according to the progress of technology and development of economy in good time.
生產(chǎn)經(jīng)營單位必須執(zhí)行依法制定的保障安全生產(chǎn)的國家標準或者行業(yè)標準。
The production and business operation entities must enforce the national standards and industrial standards that have been lawfully formulated for guaranteeing production safety.
第十一條 各級人民政府及其有關(guān)部門應(yīng)當(dāng)采取多種形式，加強對有關(guān)安全生產(chǎn)的法律、法規(guī)和安全生產(chǎn)知識的宣傳，提高職工的安全生產(chǎn)意識。
Article 11 The people's governments at all levels and the relevant departments thereof shall take various forms to strengthen the publicity of laws and regulations concerning production safety and knowledge about production safety so as to enhance the consciousness of the workers about production safety.
第十二條 依法設(shè)立的為安全生產(chǎn)提供技術(shù)服務(wù)的中介機構(gòu)，依照法律、行政法規(guī)和執(zhí)業(yè)準則，接受生產(chǎn)經(jīng)營單位的委托為其安全生產(chǎn)工作提供技術(shù)服務(wù)。
Article 12 The intermediary institutions that are lawfully established for providing technological services in production safety accepts the entrustment of the production and business operation entities to provide technological services in production safety according to the provisions of laws, administrative regulations and code of conduct.
第十三條 國家實行生產(chǎn)安全事故責(zé)任追究制度，依照本法和有關(guān)法律、法規(guī)的規(guī)定，追究生產(chǎn)安全事故責(zé)任人員的法律責(zé)任。
Article 13 The system of affixing responsibilities to production safety accidents is implemented in our country and those who are held to be responsible for production safety accidents shall be affixed legal liabilities according to the present law and other provisions of the relevant laws and regulations.
第十四條 國家鼓勵和支持安全生產(chǎn)科學(xué)技術(shù)研究和安全生產(chǎn)先進技術(shù)的推廣應(yīng)用，提高安全生產(chǎn)水平。
Article 14 The state encourages and supports the research of production safety science and technology and the popularization and application of advanced technologies of production safety so as to improve the level of production safety.
第十五條 國家對在改善安全生產(chǎn)條件、防止生產(chǎn)安全事故、參加搶險救護等方面取得顯著成績的單位和個人，給予獎勵。
Article 15 The state rewards those entities and individuals that have made outstanding achievements in the improvement of conditions of production safety, preventing production safety accidents, and rescue and relief in emergencies, etc.
第二章 生產(chǎn)經(jīng)營單位的安全生產(chǎn)保障
Chapter II Guarantee of Safety by Production and Business Operation Entities
第十六條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)具備本法和有關(guān)法律、行政法規(guī)和國家標準或者行業(yè)標準規(guī)定的安全生產(chǎn)條件；
Article 16 The production and business operation entities shall be equipped with the conditions for safe production as provided in the present law and other relevant laws, administrative regulations, national standards and industrial standards.
不具備安全生產(chǎn)條件的，不得從事生產(chǎn)經(jīng)營活動。
Any entity that is not equipped with the conditions for safe production may not engage in production and business operation activities.
第十七條 生產(chǎn)經(jīng)營單位的主要負責(zé)人對本單位安全生產(chǎn)工作負有下列職責(zé)：
Article 17 The major persons-in-charge of the production and business operation entities shall have the following duties and responsibilities regarding the production safety of their own entity:
（一）建立、健全本單位安全生產(chǎn)責(zé)任制；
a. Establishing and perfecting the system of responsibility relating to production safety;
（二）組織制定本單位安全生產(chǎn)規(guī)章制度和操作規(guī)程；
b. Organizing the formulation of rules of safe production and operational rules of the entity;
（三）保證本單位安全生產(chǎn)投入的有效實施；
c. Ensuring the effective execution of input in production safety;
（四）督促、檢查本單位的安全生產(chǎn)工作，及時消除生產(chǎn)安全事故隱患；
d. Overseeing and inspecting the work of production safety of the entity and eliminating in good time the potential production safety accidents;
（五）組織制定并實施本單位的生產(chǎn)安全事故應(yīng)急救援預(yù)案；
e. Organizing the formulation and execution of plans for emergency rescue and relief of production safety accidents of the entity
（六）及時、如實報告生產(chǎn)安全事故。
f. Reporting production safety accidents truthfully and in good time.
第十八條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)具備的安全生產(chǎn)條件所必需的資金投入，由生產(chǎn)經(jīng)營單位的決策機構(gòu)、主要負責(zé)人或者個人經(jīng)營的投資人予以保證，并對由于安全生產(chǎn)所必需的資金投入不足導(dǎo)致的后果承擔(dān)責(zé)任。
Article 18 The capital investment necessary for the conditions for the safe production of the production and business operation entities shall guaranteed by the decision-making organ and major persons-in-charge of the production and business operation entities or the investors of the private enterprises who shall be responsible for the aftermaths of insufficient capital investment necessary for safe production.
第十九條 礦山、建筑施工單位和危險物品的生產(chǎn)、經(jīng)營、儲存單位，應(yīng)當(dāng)設(shè)置安全生產(chǎn)管理機構(gòu)或者配備專職安全生產(chǎn)管理人員。
Article 19 The mines and construction entities as well as those engaged in the production, selling and storage of hazardous substances shall establish an administrative organ for production safety or have full-time personnel for the administration of production safety.
前款規(guī)定以外的其他生產(chǎn)經(jīng)營單位，從業(yè)人員超過三百人的，應(yīng)當(dāng)設(shè)置安全生產(chǎn)管理機構(gòu)或者配備專職安全生產(chǎn)管理人員；從業(yè)人員在三百人以下的，應(yīng)當(dāng)配備專職或者兼職的安全生產(chǎn)管理人員，或者委托具有國家規(guī)定的相關(guān)專業(yè)技術(shù)資格的工程技術(shù)人員提供安全生產(chǎn)管理服務(wù)。
The production and business operation entities not mentioned in the preceding paragraph but have more than 300 employees shall establish an administrative organ for production safety or have full-time personnel for the administration of production safety; if they have fewer than 300 employees, they shall have full-time or part-time personnel for the administration of production safety or entrust the engineering technicians who are equipped with the relevant professional technical qualifications as provided by the state to provide services in the administration of production safety.
生產(chǎn)經(jīng)營單位依照前款規(guī)定委托工程技術(shù)人員提供安全生產(chǎn)管理服務(wù)的，保證安全生產(chǎn)的責(zé)任仍由本單位負責(zé)。
Where any production and business operation entity that entrusts engineering technicians to provide services in the administration of production safety as provided in the preceding paragraph, the responsibility for ensuring safe production shall also remain with the entity itself.
第二十條 生產(chǎn)經(jīng)營單位的主要負責(zé)人和安全生產(chǎn)管理人員必須具備與本單位所從事的生產(chǎn)經(jīng)營活動相應(yīng)的安全生產(chǎn)知識和管理能力。
Article 20 The major persons-in-charge and the personnel for the administration of production safety of the production and business operation entities shall have the knowledge and management capacity that match the production and business operation activities of the entities concerned.
危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位的主要負責(zé)人和安全生產(chǎn)管理人員，應(yīng)當(dāng)由有關(guān)主管部門對其安全生產(chǎn)知識和管理能力考核合格后方可任職。
The persons-in-charge and the personnel for the administration of production safety of the entities that are engaged in the production, selling and storage of hazardous substances and the mines and construction entities shall not take their positions until they have passed the examinations of the administrative departments concerning the knowledge and management capacity of production safety.
考核不得收費。
No fees may be charged for such examinations.
第二十一條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)對從業(yè)人員進行安全生產(chǎn)教育和培訓(xùn)，保證從業(yè)人員具備必要的安全生產(chǎn)知識，熟悉有關(guān)的安全生產(chǎn)規(guī)章制度和安全操作規(guī)程，掌握本崗位的安全操作技能。
Article 21 The production and business operation entities shall offer education and training programs to the employees thereof regarding production safety so as to ensure that the employees have the necessary knowledge of production safety, know the relevant regulations and rules for safe production and the rules for safe operation, and master the skills for safe operation for their own positions.
未經(jīng)安全生產(chǎn)教育和培訓(xùn)合格的從業(yè)人員，不得上崗作業(yè)。
No employee who has not passed the education and training programs regarding production safety may start to work at his position.
第二十二條 生產(chǎn)經(jīng)營單位采用新工藝、新技術(shù)、新材料或者使用新設(shè)備，必須了解、掌握其安全技術(shù)特性，采取有效的安全防護措施，并對從業(yè)人員進行專門的安全生產(chǎn)教育和培訓(xùn)。
Article 22 Where any production and business operation entities employs any new technique, new technology, new material or new equipment, it must know and have good understanding of the safety and technical feature thereof, take effective measures for safety production and give special education and training programs to the employees concerned about production safety.
第二十三條 生產(chǎn)經(jīng)營單位的特種作業(yè)人員必須按照國家有關(guān)規(guī)定經(jīng)專門的安全作業(yè)培訓(xùn)，取得特種作業(yè)操作資格證書，方可上崗作業(yè)。
Article 23 The special operation staff members of the production and business operation entities may not start to work at their positions until they have passed the special training regarding safe operations and obtained qualification certificates for special operations according to the relevant provisions of the state.
特種作業(yè)人員的范圍由國務(wù)院負責(zé)安全生產(chǎn)監(jiān)督管理的部門會同國務(wù)院有關(guān)部門確定。
The scope of special operation staff shall be determined by the department State Council in charge of the supervision and administration of production safety in collaboration with the other relevant departments of the State Council.
第二十四條 生產(chǎn)經(jīng)營單位新建、改建、擴建工程項目（以下統(tǒng)稱建設(shè)項目）的安全設(shè)施，必須與主體工程同時設(shè)計、同時施工、同時投入生產(chǎn)和使用。
Article 24 The safety facilities of the newly built or rebuilt or expanded engineering projects of the production and business operation entities (hereinafter referred to as construction projects as a general term) shall be designed, built and put into production and use at the same time of the principal part of the projects.
安全設(shè)施投資應(yīng)當(dāng)納入建設(shè)項目概算。
The investment in safety facilities shall be incorporated in the budgetary estimates of the construction projects concerned.
第二十五條 礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目，應(yīng)當(dāng)分別按照國家有關(guān)規(guī)定進行安全條件論證和安全評價。
Article 25 Safety conditions argumentations and safety appraisals shall be made according to the relevant provisions of the state to the mining construction projects and the construction projects for the production and storage of hazardous substances respectively.
第二十六條 建設(shè)項目安全設(shè)施的設(shè)計人、設(shè)計單位應(yīng)當(dāng)對安全設(shè)施設(shè)計負責(zé)。
Article 26 The designers or designing entities for the safety facilities of construction projects shall take responsibility for their designs of safety facilities.
礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目的安全設(shè)施設(shè)計應(yīng)當(dāng)按照國家有關(guān)規(guī)定報經(jīng)有關(guān)部門審查，審查部門及其負責(zé)審查的人員對審查結(jié)果負責(zé)。
The safety facility designs of the mining construction projects and the construction projects for the production and storage of hazardous substances shall be subject to the examination and approval of relevant departments according to the relevant provisions of the state, and the examination and approval departments and the persons thereof in charge of examinations and approval shall be responsible for the result of examination and approval.
第二十七條 礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目的施工單位必須按照批準的安全設(shè)施設(shè)計施工，并對安全設(shè)施的工程質(zhì)量負責(zé)。
Article 27 The mining construction projects and the construction entities of the construction projects for the production and storage of hazardous substances shall execute the constructions according to the approved designs of safety facilities, and shall be responsible for the quality of the construction of safety facilities.
礦山建設(shè)項目和用于生產(chǎn)、儲存危險物品的建設(shè)項目竣工投入生產(chǎn)或者使用前，必須依照有關(guān)法律、行政法規(guī)的規(guī)定對安全設(shè)施進行驗收；
After a mining construction project or a construction project for the production and storage of hazardous substances is completed and before it is put into production or put into use, the safety facilities thereof shall be subject to check and approval according to the relevant provisions of laws and administrative regulations.
驗收合格后，方可投入生產(chǎn)和使用。
They may be put into production or use only after they have passed the check and approval.
驗收部門及其驗收人員對驗收結(jié)果負責(zé)。
The department in charge of the check and approval shall be responsible for the results of check and approval.
第二十八條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)在有較大危險因素的生產(chǎn)經(jīng)營場所和有關(guān)設(shè)施、設(shè)備上，設(shè)置明顯的安全警示標志。
Article 28 The production and business operation entities shall set up eye-catching safety warning marks at the production or business operation sites that have substantial dangerous elements or on the relevant facilities or equipments.
第二十九條 安全設(shè)備的設(shè)計、制造、安裝、使用、檢測、維修、改造和報廢，應(yīng)當(dāng)符合國家標準或者行業(yè)標準。
Article 29 The designing, manufacturing, installation, using, checking, maintenance, reforming and claiming as useless of safety equipments shall be in conformity with the national standards or industrial standards.
生產(chǎn)經(jīng)營單位必須對安全設(shè)備進行經(jīng)常性維護、保養(yǎng)，并定期檢測，保證正常運轉(zhuǎn)。
The production and business operation entities shall service, maintain the safety facilities often and check them regularly so as to ensure the normal operation thereof.
維護、保養(yǎng)、檢測應(yīng)當(dāng)作好記錄，并由有關(guān)人員簽字。
Records shall be made for the services, to which the signature of relevant persons shall be affixed.
第三十條 生產(chǎn)經(jīng)營單位使用的涉及生命安全、危險性較大的特種設(shè)備，以及危險物品的容器、運輸工具，必須按照國家有關(guān)規(guī)定，由專業(yè)生產(chǎn)單位生產(chǎn)，并經(jīng)取得專業(yè)資質(zhì)的檢測、檢驗機構(gòu)檢測、檢驗合格，取得安全使用證或者安全標志，方可投入使用。
Article 30 The special equipment that concerns the safety of life or is rather dangers, the container of hazardous substances or the transportation tool that any production and business operation entity uses shall, according to the relevant provisions of the state, be manufactured by the specialized production entities, and only after it has passed the detections and tests of the detecting and testing institutions that are equipped with the professional qualifications for which a certificate for safe use or a mark of safety has been obtained could it be put into use.
檢測、檢驗機構(gòu)對檢測、檢驗結(jié)果負責(zé)。
The detecting and testing institutions shall be responsible for the results of their detections and tests.
涉及生命安全、危險性較大的特種設(shè)備的目錄由國務(wù)院負責(zé)特種設(shè)備安全監(jiān)督管理的部門制定，報國務(wù)院批準后執(zhí)行。
The list of special equipments that concern the safety of life or that are rather dangerous shall be formulated by the department of the State Council in charge of the supervision and administration of such special equipments, and shall be executed after the approval of the State Council has been obtained.
第三十一條 國家對嚴重危及生產(chǎn)安全的工藝、設(shè)備實行淘汰制度。
Article 31 The techniques and equipments that seriously endangers the safety of production shall be eliminated by the state.
生產(chǎn)經(jīng)營單位不得使用國家明令淘汰、禁止使用的危及生產(chǎn)安全的工藝、設(shè)備。
No production and business operation entity may use any technique or equipment that endangers production safety and that has been explicitly announced for elimination or prevent from use.
第三十二條 生產(chǎn)、經(jīng)營、運輸、儲存、使用危險物品或者處置廢棄危險物品的，由有關(guān)主管部門依照有關(guān)法律、法規(guī)的規(guī)定和國家標準或者行業(yè)標準審批并實施監(jiān)督管理。
Article 32 The production, business operation, transportation, storage and use of any hazardous substances or dispose of or abandon hazardous substances shall be subject to the examination and approval as well as the supervision and administration of relevant administrative departments according to the provisions of relevant laws and regulations, national standards or industrial standards.
生產(chǎn)經(jīng)營單位生產(chǎn)、經(jīng)營、運輸、儲存、使用危險物品或者處置廢棄危險物品，必須執(zhí)行有關(guān)法律、法規(guī)和國家標準或者行業(yè)標準，建立專門的安全管理制度，采取可靠的安全措施，接受有關(guān)主管部門依法實施的監(jiān)督管理。
For the production, business operation, transportation, storage and use of any hazardous substance or disposal or abandoning of any hazardous substance by any production and business operation entity, the entity shall execute the provisions of relevant laws and regulations as well as the national standards or industrial standards, and establish specialized safety administration rules, take reliable safety measures, and accept the supervision and administration lawfully carried out by relevant administrative departments.
第三十三條 生產(chǎn)經(jīng)營單位對重大危險源應(yīng)當(dāng)?shù)怯浗n，進行定期檢測、評估、監(jiān)控，并制定應(yīng)急預(yù)案，告知從業(yè)人員和相關(guān)人員在緊急情況下應(yīng)當(dāng)采取的應(yīng)急措施。
Article 33 Production and business operation entities shall have archivist files for substantial hazardous sources, make regular checks, appraisals, supervisions and controls, make emergency plans, and inform the employees and other relevant people of the emergency measures that should be taken under emergent circumstances.
生產(chǎn)經(jīng)營單位應(yīng)當(dāng)按照國家有關(guān)規(guī)定將本單位重大危險源及有關(guān)安全措施、應(yīng)急措施報有關(guān)地方人民政府負責(zé)安全生產(chǎn)監(jiān)督管理的部門和有關(guān)部門備案。
The production and business operation entities shall report, according to the relevant provisions of the state, the substantial hazardous sources and the corresponding safety measures and emergency measures to the administrative department and other relevant departments of the local people's government in charge of the supervision and administration of production safety for archivist purposes.
第三十四條 生產(chǎn)、經(jīng)營、儲存、使用危險物品的車間、商店、倉庫不得與員工宿舍在同一座建筑物內(nèi)，并應(yīng)當(dāng)與員工宿舍保持安全距離。
Article 34 The workshops, stores, warehouses that produce, manage, store or use hazardous substances may not be located in the same building as the dormitories of the employees, and there should be a safe distance between them and the dormitories.
生產(chǎn)經(jīng)營場所和員工宿舍應(yīng)當(dāng)設(shè)有符合緊急疏散要求、標志明顯、保持暢通的出口。禁止封閉、堵塞生產(chǎn)經(jīng)營場所或者員工宿舍的出口。
For the sites of production and business operation and the dormitories of the employees, there shall be exits that meet the requirements for emergent dispersal of people, have eye-catching marks and be clear of obstructions. It shall be prohibited to close or obstruct the exits of the sites of production and business operation and the dormitories of the employees.
第三十五條 生產(chǎn)經(jīng)營單位進行爆破、吊裝等危險作業(yè)，應(yīng)當(dāng)安排專門人員進行現(xiàn)場安全管理，確保操作規(guī)程的遵守和安全措施的落實。
Article 35 To carry out the operations of explosions and hoistings, the production and business operation entities shall arrange for special persons to take charge of the on-spot safety so as to ensure that the operational rules be observed and the safety measures be carried out.
第三十六條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)教育和督促從業(yè)人員嚴格執(zhí)行本單位的安全生產(chǎn)規(guī)章制度和安全操作規(guī)程；并向從業(yè)人員如實告知作業(yè)場所和工作崗位存在的危險因素、防范措施以及事故應(yīng)急措施。
Article 36 The production and business operation entities shall educate and urge the employees thereof to observe strictly the regulations and rules thereof for safe production and the rules for safe operations, and shall inform truthfully the employees of the dangerous elements that exist in the site of operations and work positions, of the prevention measures and corresponding emergency measures for dealing with accidents.
第三十七條 生產(chǎn)經(jīng)營單位必須為從業(yè)人員提供符合國家標準或者行業(yè)標準的勞動防護用品，并監(jiān)督、教育從業(yè)人員按照使用規(guī)則佩戴、使用。
Article 37 The production and business operation entities shall provide labor protection articles that meet the national standards or industrial standards to the employees thereof, supervise and educate them to wear or use these articles according to the prescribed rules.
第三十八條 生產(chǎn)經(jīng)營單位的安全生產(chǎn)管理人員應(yīng)當(dāng)根據(jù)本單位的生產(chǎn)經(jīng)營特點，對安全生產(chǎn)狀況進行經(jīng)常性檢查；
Article 38 The persons in charge of the production safety of the production and business operation entities shall conduct regular inspections over the production safety of the entities concerned by taking the peculiarities of business operation of the entities into consideration.
對檢查中發(fā)現(xiàn)的安全問題，應(yīng)當(dāng)立即處理；不能處理的，應(yīng)當(dāng)及時報告本單位有關(guān)負責(zé)人。
The safety problems that are found out in the inspections shall be dealt with immediately; if they cannot deal with the problems, they shall report to the relevant persons-in-charge of the entities in good time.
檢查及處理情況應(yīng)當(dāng)記錄在案。
Records shall be taken for the inspections and the handling of the problems.
第三十九條 生產(chǎn)經(jīng)營單位應(yīng)當(dāng)安排用于配備勞動防護用品、進行安全生產(chǎn)培訓(xùn)的經(jīng)費。
Article 39 The production and business operation entities shall arrange funds buying labor protection articles and holding trainings in production safety.
第四十條 兩個以上生產(chǎn)經(jīng)營單位在同一作業(yè)區(qū)域內(nèi)進行生產(chǎn)經(jīng)營活動，可能危及對方生產(chǎn)安全的，應(yīng)當(dāng)簽訂安全生產(chǎn)管理協(xié)議，明確各自的安全生產(chǎn)管理職責(zé)和應(yīng)當(dāng)采取的安全措施，并指定專職安全生產(chǎn)管理人員進行安全檢查與協(xié)調(diào)。
Article 40 Two or more production and business operations that conduct production and business operation activities within a same area and may endanger the production safety of each other shall enter into agreements concerning the administration of production safety so as to specify the duties and functions of each other in the administration of production safety as well as the safety measures to be taken, and shall arrange for full-time persons in charge of the administration of production safety to conduction safety inspections and coordinations.
第四十一條 生產(chǎn)經(jīng)營單位不得將生產(chǎn)經(jīng)營項目、場所、設(shè)備發(fā)包或者出租給不具備安全生產(chǎn)條件或者相應(yīng)資質(zhì)的單位或者個人。
Article 41 No production and business operation entity may contract or lease any project, site or equipment of production and business operation to any entity or person that does not have the conditions for safe production or have the corresponding qualifications.
生產(chǎn)經(jīng)營項目、場所有多個承包單位、承租單位的，生產(chǎn)經(jīng)營單位應(yīng)當(dāng)與承包單位、承租單位簽訂專門的安全生產(chǎn)管理協(xié)議，或者在承包合同、租賃合同中約定各自的安全生產(chǎn)管理職責(zé)；
In case a production and business operation project or site is contracted or leased to more than one entity, the production and business operation entity shall enter into special agreements with the contractor or leaseholder concerning the administration of production safety, or stipulate in the contracting agreements or leasehold contracts the duties and functions of each party in the administration of production safety.
生產(chǎn)經(jīng)營單位對承包單位、承租單位的安全生產(chǎn)工作統(tǒng)一協(xié)調(diào)、管理。
The production and business operation entity shall exercise unified coordination and administration over the contractors and leaseholders concerning the work of production safety.
第四十二條 生產(chǎn)經(jīng)營單位發(fā)生重大生產(chǎn)安全事故時，單位的主要負責(zé)人應(yīng)當(dāng)立即組織搶救，并不得在事故調(diào)查處理期間擅離職守。
Article 42 Where any serious production safety accident occurs in any production and business operation entity, the major persons-in-charge of the entity shall organize immediate rescues and may not leave their positions with out permission during the period for investigating and handling the accident.
第四十三條 生產(chǎn)經(jīng)營單位必須依法參加工傷社會保險，為從業(yè)人員繳納保險費。
Article 43 The production and business operation entities must buy employment injury insurances according to law, and pay insurance premiums for the employees thereof.
第三章 從業(yè)人員的權(quán)利和義務(wù)
Chapter III Rights and Obligations of Employees
第四十四條 生產(chǎn)經(jīng)營單位與從業(yè)人員訂立的勞動合同，應(yīng)當(dāng)載明有關(guān)保障從業(yè)人員勞動安全、防止職業(yè)危害的事項，以及依法為從業(yè)人員辦理工傷社會保險的事項。
Article 44 In the employment contracts entered into between the production and business operations and the employees, it shall include stipulations about the guarantee of the labor safety of the employees, the avoidance of vocational injuries, and the buying of employment injury insurances for the employees thereof according to law.
生產(chǎn)經(jīng)營單位不得以任何形式與從業(yè)人員訂立協(xié)議，免除或者減輕其對從業(yè)人員因生產(chǎn)安全事故傷亡依法應(yīng)承擔(dān)的責(zé)任。
No production and business operation entity may conclude any agreement with the employees thereof so as to exempt or mitigate the liabilities which result from any production safety accident casualties occurred to the employees thereof and which it has to undertake.
第四十五條 生產(chǎn)經(jīng)營單位的從業(yè)人員有權(quán)了解其作業(yè)場所和工作崗位存在的危險因素、防范措施及事故應(yīng)急措施，有權(quán)對本單位的安全生產(chǎn)工作提出建議。
Article 45 The employees of a production and business operation entity shall be entitled to know the dangerous elements that exist in the site or position of work as well as the corresponding prevention measures and emergency measures; they shall be entitled to give suggestions concerning the work of production safety of the entity where they work.
第四十六條 從業(yè)人員有權(quán)對本單位安全生產(chǎn)工作中存在的問題提出批評、檢舉、控告；有權(quán)拒絕違章指揮和強令冒險作業(yè)。
Article 46 The employees shall be entitled to criticize, expose or institute legal proceedings on the ground of the problems that exist in the production safety of the entity concerned.
生產(chǎn)經(jīng)營單位不得因從業(yè)人員對本單位安全生產(chǎn)工作提出批評、檢舉、控告或者拒絕違章指揮、強令冒險作業(yè)而降低其工資、福利等待遇或者解除與其訂立的勞動合同。
The production and business operation entity may not lower the salaries or welfare or other treatment or dissolve the labor contracts entered into with the employees simply because the employee concerned has criticized, exposed or filed lawsuits on the ground of the problems existing in the production safety of the entity or because he has refused to give directions as against the operational rules or to force people to work in risks.
第四十七條 從業(yè)人員發(fā)現(xiàn)直接危及人身安全的緊急情況時，有權(quán)停止作業(yè)或者在采取可能的應(yīng)急措施后撤離作業(yè)場所。
Article 47 Where any employee finds any emergency that may directly endanger the personal safety of himself or any other person, he shall be entitled to stop work or leave the site of work after taking possible emergency measures.
生產(chǎn)經(jīng)營單位不得因從業(yè)人員在前款緊急情況下停止作業(yè)或者采取緊急撤離措施而降低其工資、福利等待遇或者解除與其訂立的勞動合同。
No production and business operation entity may lower the salaries or welfare or other treatment of the employee concerned or dissolve the labor contract entered into with the employee concerned simply because he has stopped work or left under emergent circumstances as mentioned in the preceding paragraph.
第四十八條 因生產(chǎn)安全事故受到損害的從業(yè)人員，除依法享有工傷社會保險外，依照有關(guān)民事法律尚有獲得賠償?shù)臋?quán)利的，有權(quán)向本單位提出賠償要求。
Article 48 The employees that suffered injuries in production safety accidents shall be entitled to claim compensations against the entity concerned if, according to the civil laws, they have the right to do so apart from enjoying the employment injury insurances according to law.
第四十九條 從業(yè)人員在作業(yè)過程中，應(yīng)當(dāng)嚴格遵守本單位的安全生產(chǎn)規(guī)章制度和操作規(guī)程，服從管理，正確佩戴和使用勞動防護用品。
Article 49 The employees shall, in work, rigidly observe the rules and regulations concerning production safety and the operational rules of the entities concerned, obey their administration, and correctly wear and use labor protection articles.
第五十條 從業(yè)人員應(yīng)當(dāng)接受安全生產(chǎn)教育和培訓(xùn)，掌握本職工作所需的安全生產(chǎn)知識，提高安全生產(chǎn)技能，增強事故預(yù)防和應(yīng)急處理能力。
Article 50 The employees shall accept education and training in production safety, be equipped with the knowledge of production safety necessary for their work so as to improve their skills in production safety and enable themselves to prevent from accidents and handle emergencies.
第五十一條 從業(yè)人員發(fā)現(xiàn)事故隱患或者其他不安全因素，應(yīng)當(dāng)立即向現(xiàn)場安全生產(chǎn)管理人員或者本單位負責(zé)人報告；接到報告的人員應(yīng)當(dāng)及時予以處理。
Article 51 Any employee who finds out any potential accidents or other insecure elements shall report immediately to the person in charge of the on-spot administration of production safety or the person-in-charge of the entity concerned. The person who receives the report shall handle them in good time.
第五十二條 工會有權(quán)對建設(shè)項目的安全設(shè)施與主體工程同時設(shè)計、同時施工、同時投入生產(chǎn)和使用進行監(jiān)督，提出意見。
Article 52 The trade unions shall be entitled to see to it that the safety facilities are designed, constructed and put into use at the same time as the main part of the construction projects, and shall be entitled to their comments.
工會對生產(chǎn)經(jīng)營單位違反安全生產(chǎn)法律、法規(guī)，侵犯從業(yè)人員合法權(quán)益的行為，有權(quán)要求糾正；
The trade unions shall be entitled to demand the production and business operation entity to mend up any act thereof that has violated the provisions of any law or regulation regarding production safety and injured the lawful rights and interests of the employees.
發(fā)現(xiàn)生產(chǎn)經(jīng)營單位違章指揮、強令冒險作業(yè)或者發(fā)現(xiàn)事故隱患時，有權(quán)提出解決的建議，生產(chǎn)經(jīng)營單位應(yīng)當(dāng)及時研究答復(fù)；
When they find that the production and business operation entity gives directions as against the rules and regulations, force people to work in risks or discover any potential accidents, they shall be entitled to give their suggestions, and the production and business operation entities shall take into consideration and give replies in good time.
發(fā)現(xiàn)危及從業(yè)人員生命安全的情況時，有權(quán)向生產(chǎn)經(jīng)營單位建議組織從業(yè)人員撤離危險場所，生產(chǎn)經(jīng)營單位必須立即作出處理。
When they discover any circumstance endangering the life of the employees, they shall be entitled to suggest the production and business operation entity to organize the employees to leave the dangerous site, and the production and business operation entity to react without delay.
工會有權(quán)依法參加事故調(diào)查，向有關(guān)部門提出處理意見，并要求追究有關(guān)人員的責(zé)任。
The trade unions shall be entitled to participate in the investigations of accidents, give their comments on the handling of accidents and request relevant personnel to undertake responsibilities.
第四章 安全生產(chǎn)的監(jiān)督管理
Chapter IV Supervision and Administration of Production Safety
第五十三條 縣級以上地方各級人民政府應(yīng)當(dāng)根據(jù)本行政區(qū)域內(nèi)的安全生產(chǎn)狀況，組織有關(guān)部門按照職責(zé)分工，對本行政區(qū)域內(nèi)容易發(fā)生重大生產(chǎn)安全事故的生產(chǎn)經(jīng)營單位進行嚴格檢查；
Article 53 The local people's governments on the county level and above shall, according to the situation of production safety within their respective administrative jurisdictions, organize the relevant departments to inspect, according to their functions and duties, the production and business operation entities within their respective administrative jurisdiction where serious production safety accidents are apt to occur.
發(fā)現(xiàn)事故隱患，應(yīng)當(dāng)及時處理。
In case any potential accident is discovered, it shall be handled without delay.
第五十四條 依照本法第九條規(guī)定對安全生產(chǎn)負有監(jiān)督管理職責(zé)的部門（以下統(tǒng)稱負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門）依照有關(guān)法律、法規(guī)的規(guī)定，對涉及安全生產(chǎn)的事項需要審查批準（包括批準、核準、許可、注冊、認證、頒發(fā)證照等，下同）或者驗收的，必須嚴格依照有關(guān)法律、法規(guī)和國家標準或者行業(yè)標準規(guī)定的安全生產(chǎn)條件和程序進行審查；
Article 54 If anything relating to production safety shall be subject to examination and approval according to the provisions of relevant laws and regulations (including approval, verification, permission, registration, certification, granting licenses, etc.), the departments that have the duty of supervising and administering production safety according to Article 9 of the present law (hereafter "the departments responsible for the supervision and administration of production safety") shall carry out the examination and approval by strictly following the relevant laws and regulations as well as the conditions and procedures for safe production as required by national or industrial standards.
不符合有關(guān)法律、法規(guī)和國家標準或者行業(yè)標準規(guī)定的安全生產(chǎn)條件的，不得批準或者驗收通過。
If it is not in conformity with the provisions of relevant laws or regulations or it does not meet the conditions for safe production as required by national or industrial standards, it shall not be approved or shall not pass the examinations for acceptance.
對未依法取得批準或者驗收合格的單位擅自從事有關(guān)活動的，負責(zé)行政審批的部門發(fā)現(xiàn)或者接到舉報后應(yīng)當(dāng)立即予以取締，并依法予以處理。
In case the administrative department in charge of examination and approval discovers or receives reports that any entity is unlawfully engaged in relevant activities without obtaining approval or without passing the examinations for acceptance, it shall revoke the unlawful act without delay and handle the case according to law.
對已經(jīng)依法取得批準的單位，負責(zé)行政審批的部門發(fā)現(xiàn)其不再具備安全生產(chǎn)條件的，應(yīng)當(dāng)撤銷原批準。
If the entity has already obtained approval according to law and the administrative department in charge of examination and approval finds that the entity no longer meets the conditions for safe production, it shall cancel the original approval.
第五十五條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門對涉及安全生產(chǎn)的事項進行審查、驗收，不得收取費用；不得要求接受審查、驗收的單位購買其指定品牌或者指定生產(chǎn)、銷售單位的安全設(shè)備、器材或者其他產(chǎn)品。
Article 55 The departments responsible for the supervision and administration of production safety may not collect any fee for the examinations and approval for the matters relating to production safety, and may not demand the entities subject to examination and approval or examination for acceptance to buy the brands designated thereby or to buy the safety equipments, facilities or other products produced or sold by the entities designated thereby.
第五十六條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門依法對生產(chǎn)經(jīng)營單位執(zhí)行有關(guān)安全生產(chǎn)的法律、法規(guī)和國家標準或者行業(yè)標準的情況進行監(jiān)督檢查，行使以下職權(quán)：
Article 56 A department responsible for the supervision and administration of production safety supervise and inspect according to law the executions of the relevant laws and regulations concerning production safety and the national or industrial standards by the production and business operation entities, and shall have the following duties and functions:
（一）進入生產(chǎn)經(jīng)營單位進行檢查，調(diào)閱有關(guān)資料，向有關(guān)單位和人員了解情況。
a. To make inspections at the production and business operation entities, gather relevant materials, and inquire relevant entities and persons;
（二）對檢查中發(fā)現(xiàn)的安全生產(chǎn)違法行為，當(dāng)場予以糾正或者要求限期改正；對依法應(yīng)當(dāng)給予行政處罰的行為，依照本法和其他有關(guān)法律、行政法規(guī)的規(guī)定作出行政處罰決定。
b. To correct the acts violating the statutory provisions of law and discovered in the inspections or demand for correction within a prescribed time limit; to make decisions of administrative penalties according to the provisions of the present law and other relevant laws and regulations to those acts that shall be subject to administrative penalties according to law;
（三）對檢查中發(fā)現(xiàn)的事故隱患，應(yīng)當(dāng)責(zé)令立即排除；重大事故隱患排除前或者排除過程中無法保證安全的，應(yīng)當(dāng)責(zé)令從危險區(qū)域內(nèi)撤出作業(yè)人員，責(zé)令暫時停產(chǎn)停業(yè)或者停止使用；
c. If it finds any potential accident in its inspections, it shall order them to be eliminated without delay. If safety cannot be guaranteed before a serious potential accident is eliminated or in the process of elimination, it shall order the employees at work to leave the dangerous areas, and order that the business operation or production or use be suspended or terminated.
重大事故隱患排除后，經(jīng)審查同意，方可恢復(fù)生產(chǎn)經(jīng)營和使用。
The production or business operation or use may not be resumed until the serious potential accident has been eliminated and approval has been obtained upon examination;
（四）對有根據(jù)認為不符合保障安全生產(chǎn)的國家標準或者行業(yè)標準的設(shè)施、設(shè)備、器材予以查封或者扣押，并應(yīng)當(dāng)在十五日內(nèi)依法作出處理決定。
d. Shall be entitled to seal up or detain the facilities, equipments and apparatuses that are believed as not meeting the national or industrial standards for guaranteeing production safety.
監(jiān)督檢查不得影響被檢查單位的正常生產(chǎn)經(jīng)營活動。
The supervision and inspection may not affect the normal production and business operation activities of the examinee entities.
第五十七條 生產(chǎn)經(jīng)營單位對負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門的監(jiān)督檢查人員（以下統(tǒng)稱安全生產(chǎn)監(jiān)督檢查人員）依法履行監(jiān)督檢查職責(zé)，應(yīng)當(dāng)予以配合，不得拒絕、阻撓。
Article 57 The production and business operation entities shall cooperate with and may not reject or obstruct the supervision and inspection personnel of the departments responsible for the supervision and administration of production safety (hereafter "the supervision and inspection personnel of production safety") in their lawful supervision and inspection.
第五十八條 安全生產(chǎn)監(jiān)督檢查人員應(yīng)當(dāng)忠于職守，堅持原則，秉公執(zhí)法。
Article 58 The supervision and inspection personnel of production safety shall be devoted to their duties, adhere to the principles, and be impartial in their enforcement activities.
安全生產(chǎn)監(jiān)督檢查人員執(zhí)行監(jiān)督檢查任務(wù)時，必須出示有效的監(jiān)督執(zhí)法證件；對涉及被檢查單位的技術(shù)秘密和業(yè)務(wù)秘密，應(yīng)當(dāng)為其保密。
The supervision and inspection personnel of production safety shall, when discharging their duties, show valid certificates of supervision enforcement, and shall keep secret if any of the technological secret or business secret of the entity subject to inspection is involved.
第五十九條 安全生產(chǎn)監(jiān)督檢查人員應(yīng)當(dāng)將檢查的時間、地點、內(nèi)容、發(fā)現(xiàn)的問題及其處理情況，作出書面記錄，并由檢查人員和被檢查單位的負責(zé)人簽字；
Article 59 The supervision and inspection personnel of production safety shall make written records of the time and place of the inspection, what is the inspection about, the problems discovered and how they are dealt with, and affix their signatures of the inspectors and person-in-charge of the inspected entity.
被檢查單位的負責(zé)人拒絕簽字的，檢查人員應(yīng)當(dāng)將情況記錄在案，并向負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門報告。
If the person-in-charge of the inspected entity refuses to affix his signature, the inspectors may write the situation down in the records and report to the departments responsible for the supervision and administration of production safety.
第六十條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門在監(jiān)督檢查中，應(yīng)當(dāng)互相配合，實行聯(lián)合檢查；
Article 60 The departments responsible for the supervision and administration of production safety shall, in their supervision and administration activities, cooperate with each other by way of joint inspections.
確需分別進行檢查的，應(yīng)當(dāng)互通情況。
If it necessary to make inspections separately, they shall inform each other.
發(fā)現(xiàn)存在的安全問題應(yīng)當(dāng)由其他有關(guān)部門進行處理的，應(yīng)當(dāng)及時移送其他有關(guān)部門并形成記錄備查，接受移送的部門應(yīng)當(dāng)及時進行處理。
If any safety problems found have to be handled by other relevant departments, they shall be transferred to the other departments concerned and keep records for further reference. The departments that accept the transferred cases shall handle them without delay.
第六十一條 監(jiān)察機關(guān)依照行政監(jiān)察法的規(guī)定，對負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門及其工作人員履行安全生產(chǎn)監(jiān)督管理職責(zé)實施監(jiān)察。
Article 61 The government supervision authorities shall, according to the provisions concerning administrative government supervision, be responsible for supervising the execution of duties of production safety supervision and administration by the departments responsible for the supervision and administration of production safety and the personnel thereof.
第六十二條 承擔(dān)安全評價、認證、檢測、檢驗的機構(gòu)應(yīng)當(dāng)具備國家規(guī)定的資質(zhì)條件，并對其作出的安全評價、認證、檢測、檢驗的結(jié)果負責(zé)。
Article 62 The institutions undertaking the work of safety appraisal, certification, detection, and test shall be equipped with the qualifications as required by the state, and shall be responsible for the results of safety appraisal, certification, detection and test.
第六十三條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門應(yīng)當(dāng)建立舉報制度，公開舉報電話、信箱或者電子郵件地址，受理有關(guān)安全生產(chǎn)的舉報；
Article 63 The departments responsible for the supervision and administration of production safety shall establish a system of reporting violations, making public the telephone numbers, mail boxes or email addresses for reporting violations, and accept the reports for violations relating to production safety.
受理的舉報事項經(jīng)調(diào)查核實后，應(yīng)當(dāng)形成書面材料；
Any reported violation that has been accepted shall be put down in writing after it has been verified through investigations.
需要落實整改措施的，報經(jīng)有關(guān)負責(zé)人簽字并督促落實。
If any measure of rectification or improvement have to be taken, it shall be reported to the relevant person-in-charge for execution after the person-in-charge has affixed his signature.
第六十四條 任何單位或者個人對事故隱患或者安全生產(chǎn)違法行為，均有權(quán)向負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門報告或者舉報。
Article 64 Any entity or individual shall be entitled to report to the department responsible for the supervision and administration of production safety about any potential accident or any violation of statutory provisions concerning production safety.
第六十五條 居民委員會、村民委員會發(fā)現(xiàn)其所在區(qū)域內(nèi)的生產(chǎn)經(jīng)營單位存在事故隱患或者安全生產(chǎn)違法行為時，應(yīng)當(dāng)向當(dāng)?shù)厝嗣裾蛘哂嘘P(guān)部門報告。
Article 65 Any urban residents' committee or villagers committee finds potential accident or violation of statutory provisions concerning production safety exists in the production and business operation entity within its jurisdiction shall report to the people's government or other relevant department of the local place.
第六十六條 縣級以上各級人民政府及其有關(guān)部門對報告重大事故隱患或者舉報安全生產(chǎn)違法行為的有功人員，給予獎勵。
Article 66 The people's governments on the county level and above as well as the relevant departments thereof shall reward those that have meritorious acts in reporting important potential accidents or violations of statutory provisions concerning production safety.
具體獎勵辦法由國務(wù)院負責(zé)安全生產(chǎn)監(jiān)督管理的部門會同國務(wù)院財政部門制定。
The detailed measures for rewards shall be formulated by the department of the State Council responsible for the supervision and administration of production safety in collaboration with the public fiscal department of the State Council.
第六十七條 新聞、出版、廣播、電影、電視等單位有進行安全生產(chǎn)宣傳教育的義務(wù)，有對違反安全生產(chǎn)法律、法規(guī)的行為進行輿論監(jiān)督的權(quán)利。
Article 67 The entities such as news agency, publication, broadcasting, movie and television, etc. shall be under the obligation of the publicity and education of production safety, and shall have the right to conduct supervision by public opinions over the acts violating the statutory provisions concerning production safety.
第五章 生產(chǎn)安全事故的應(yīng)急救援與調(diào)查處理
Chapter V Emergency Rescue, Investigation and Handling of Production Safety Accidents
第六十八條 縣級以上地方各級人民政府應(yīng)當(dāng)組織有關(guān)部門制定本行政區(qū)域內(nèi)特大生產(chǎn)安全事故應(yīng)急救援預(yù)案，建立應(yīng)急救援體系。
Article 68 The people's governments on the county level and above shall organize relevant departments to formulate emergency rescue plans for the especially serious production safety accidents within their respective administrative jurisdictions, and establish their own systems of emergency rescue.
第六十九條 危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位應(yīng)當(dāng)建立應(yīng)急救援組織；
Article 69 The entities that produce, manage or store hazardous substances as well as the mining and construction building entities shall establish emergency rescue organizations.
生產(chǎn)經(jīng)營規(guī)模較小，可以不建立應(yīng)急救援組織的，應(yīng)當(dāng)指定兼職的應(yīng)急救援人員。
If a production and business operation is small in scale, it may designate part-time emergency rescue persons instead of establishing emergency rescue organizations.
危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位應(yīng)當(dāng)配備必要的應(yīng)急救援器材、設(shè)備，并進行經(jīng)常性維護、保養(yǎng)，保證正常運轉(zhuǎn)。
The entities that produce, manage or store hazardous substances as well as the mining and construction building entities shall be equipped with necessary rescue apparatuses and equipments which shall be serviced and maintained regularly so as to ensure their normal operation.
第七十條 生產(chǎn)經(jīng)營單位發(fā)生生產(chǎn)安全事故后，事故現(xiàn)場有關(guān)人員應(yīng)當(dāng)立即報告本單位負責(zé)人。
Article 70 When a production safety accident occurs to a production and business operation entity, the relevant persons at the spot of the accident shall report to the persons-in-charge of the entity immediately.
單位負責(zé)人接到事故報告后，應(yīng)當(dāng)迅速采取有效措施，組織搶救，防止事故擴大，減少人員傷亡和財產(chǎn)損失，并按照國家有關(guān)規(guī)定立即如實報告當(dāng)?shù)刎撚邪踩a(chǎn)監(jiān)督管理職責(zé)的部門，不得隱瞞不報、謊報或者拖延不報，不得故意破壞事故現(xiàn)場、毀滅有關(guān)證據(jù)。
The persons-in-charge of the entity shall, after receiving the report of accident, take effective measures immediately, organize rescues, and prevent the accident from deteriorating so as to reduce the casualty of personnel and property losses. They shall, according to the relevant provisions of the state, report truthfully to the departments responsible for the supervision and administration of production safety of the local place, and may not conceal anything or report deceitfully or delay the reports or ruin the spot of the accident on purpose or destroy relevant evidences.
第七十一條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門接到事故報告后，應(yīng)當(dāng)立即按照國家有關(guān)規(guī)定上報事故情況。
Article 71 The departments responsible for the supervision and administration of production safety shall, after receiving a report of accident, report the accident to the relevant authorities on higher levels according to the relevant provisions of the state.
負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門和有關(guān)地方人民政府對事故情況不得隱瞞不報、謊報或者拖延不報。
The departments responsible for the supervision and administration of production safety and the local people's governments concerned may not conceal any accident, report deceitfully or delay the report.
第七十二條 有關(guān)地方人民政府和負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門的負責(zé)人接到重大生產(chǎn)安全事故報告后，應(yīng)當(dāng)立即趕到事故現(xiàn)場，組織事故搶救。
Article 72 The persons-in-charge of the local people's governments concerned and the departments responsible for the supervision and administration of production safety shall, after receiving a report of production safety accident, hurry to the spot of the accident immediately to organize rescues.
任何單位和個人都應(yīng)當(dāng)支持、配合事故搶救，并提供一切便利條件。
All entities and individual shall support and coordinate the rescue of accident and provide all conveniences.
第七十三條 事故調(diào)查處理應(yīng)當(dāng)按照實事求是、尊重科學(xué)的原則，及時、準確地查清事故原因，查明事故性質(zhì)和責(zé)任，總結(jié)事故教訓(xùn)，提出整改措施，并對事故責(zé)任者提出處理意見。
Article 73 The principle of being practical and realistic and the principle of respecting science shall be observed in the investigation and handling of accidents. The relevant people shall find out the accurate causes of the accidents in good time sum up the lessons of the accidents, suggest measures for rectification and mending up, and give their opinions about how to deal with those who are responsible for the accidents.
事故調(diào)查和處理的具體辦法由國務(wù)院制定。
The detailed measures for the investigation and handling of accidents shall be formulated by the State Council.
第七十四條 生產(chǎn)經(jīng)營單位發(fā)生生產(chǎn)安全事故，經(jīng)調(diào)查確定為責(zé)任事故的，除了應(yīng)當(dāng)查明事故單位的責(zé)任并依法予以追究外，還應(yīng)當(dāng)查明對安全生產(chǎn)的有關(guān)事項負有審查批準和監(jiān)督職責(zé)的行政部門的責(zé)任。
Article 74 If any production safety accident happened to a production and business operation entity is found, on the basis of investigations, to be an accident due to negligence, the relevant people shall not only find out the liabilities of and fix penalties to the entity where the accident has happened, they shall also find out the liabilities of the administrative departments that are responsible for the examination and approval of the relevant matters concerning production safety.
對有失職、瀆職行為的，依照本法第七十七條的規(guī)定追究法律責(zé)任。
Any person who is found to be guilty of dereliction in duties or malfeasance shall be subject to undertaking legal liabilities according to Article 77 of the present law.
第七十五條 任何單位和個人不得阻撓和干涉對事故的依法調(diào)查處理。
Article 75 No entity or individual may obstruct or interfere with the lawful investigation and handling of accidents.
第七十六條 縣級以上地方各級人民政府負責(zé)安全生產(chǎn)監(jiān)督管理的部門應(yīng)當(dāng)定期統(tǒng)計分析本行政區(qū)域內(nèi)發(fā)生生產(chǎn)安全事故的情況，并定期向社會公布。
Article 76 The department of the local people's government on the county level and above who are responsible for the supervision and administration of production safety shall make statistical analyses regularly of the production safety accidents happened within their respective administrative regions, and publicize them to the general public.
第六章 法律責(zé)任
Chapter VI Legal Liabilities
第七十七條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門的工作人員，有下列行為之一的，給予降級或者撤職的行政處分；
Article 77 Any staff member of the departments responsible for the supervision and administration of production safety who commits any of the following acts shall be given an administrative punishment of being demoted or removed from his position.
構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任：
If his act constitutes a crime, he shall be subject to assume criminal liabilities:
（一）對不符合法定安全生產(chǎn)條件的涉及安全生產(chǎn)的事項予以批準或者驗收通過的；
a. Granting approval or accepting on the basis of examination any matter relating to production safety which does not meet the statutory conditions for production safety;
（二）發(fā)現(xiàn)未依法取得批準、驗收的單位擅自從事有關(guān)活動或者接到舉報后不予取締或者不依法予以處理的；
b. Failing to clamp down or handle according to law after finding or receiving reports that any entity which has not obtained approval or has not passed the examinations for acceptance according to law is engaged in relevant activities;
（三）對已經(jīng)依法取得批準的單位不履行監(jiān)督管理職責(zé)，發(fā)現(xiàn)其不再具備安全生產(chǎn)條件而不撤銷原批準或者發(fā)現(xiàn)安全生產(chǎn)違法行為不予查處的。
c. Finding that an entity which has obtained approval or passed the examinations for acceptance according to law but fails exercise its duties of supervision and administration and failing to withdraw the original approval or failing to investigate and handle any act violating the statutory provisions concerning production safety.
第七十八條 負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門，要求被審查、驗收的單位購買其指定的安全設(shè)備、器材或者其他產(chǎn)品的，在對安全生產(chǎn)事項的審查、驗收中收取費用的，由其上級機關(guān)或者監(jiān)察機關(guān)責(zé)令改正，責(zé)令退還收取的費用；
Article 78 Any department responsible for the supervision and administration of production safety who demand the entities subject to e, xamination and approval or examinations for acceptance to buy any safety equipment, facility or other product as designated thereby or charge any fees in the examination and approval or examination for acceptance concerning the matters of production safety shall be ordered to mend up by the competent authorities or the government supervision organs on a higher level and be ordered to refund the fees charged.
情節(jié)嚴重的，對直接負責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分。
If the circumstances are serious, the person-in-charge and other personnel who are held to be directly responsible shall be given administrative punishments according to law.
第七十九條 承擔(dān)安全評價、認證、檢測、檢驗工作的機構(gòu)，出具虛假證明，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任；
Article 79 Any institution that undertakes the work of safety appraisal, certification, detection and test issues false certificates and thus constituting a crime shall assume criminal liabilities according to the relevant provisions of the Criminal Law.
尚不夠刑事處罰的，沒收違法所得，違法所得在五千元以上的，并處違法所得二倍以上五倍以下的罰款，沒有違法所得或者違法所得不足五千元的，單處或者并處五千元以上二萬元以下的罰款，對其直接負責(zé)的主管人員和其他直接責(zé)任人員處五千元以上五萬元以下的罰款；
If the acts thereof are not enough for criminal punishments, the illegal proceeds shall be confiscated and at the same time, it shall be imposed upon a fine of not less than two times but not more than five times the illegal proceeds if the illegal proceeds are more than 5,000 yuan; or, if the illegal proceeds are less than 5,000 yuan, be simply imposed upon a fine of not less than 5,000 yuan but not more than 20,000 yuan, and the person-in-charge and other persons who are held to be directly responsible shall be imposed a fine of not less than 5,000 yuan but not more than 50,000 yuan.
給他人造成損害的，與生產(chǎn)經(jīng)營單位承擔(dān)連帶賠償責(zé)任。
If injuries have been caused to other people, it shall take several and joint liabilities with the production and business operation entity.
對有前款違法行為的機構(gòu)，撤銷其相應(yīng)資格。
Any institution that has committed any of the illegal acts as mentioned in the preceding paragraph shall be disqualified accordingly.
第八十條 生產(chǎn)經(jīng)營單位的決策機構(gòu)、主要負責(zé)人、個人經(jīng)營的投資人不依照本法規(guī)定保證安全生產(chǎn)所必需的資金投入，致使生產(chǎn)經(jīng)營單位不具備安全生產(chǎn)條件的，責(zé)令限期改正，提供必需的資金；
Article 80 If the decision-making organ or major person-in-charge of any production and business operation entity or the investor of any individually run business fails to ensure the capital investment necessary for guaranteeing the production safety as provided in the present law so that the production and business operation entity no longer meets the requirements for safety production, the entity shall be ordered to mend up within a prescribed time period and provide the necessary capital investment.
逾期未改正的，責(zé)令生產(chǎn)經(jīng)營單位停產(chǎn)停業(yè)整頓。
If it fails to mend up within the prescribed time period, the production and business operation entity shall be ordered to suspend business for rectifications.
有前款違法行為，導(dǎo)致發(fā)生生產(chǎn)安全事故，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任；
If any of the illegal acts as mentioned in the preceding paragraph has resulted in any production safety accident and a crime is constituted, the offenders concerned shall assume criminal liabilities according to the relevant provisions of the Criminal Law.
尚不夠刑事處罰的，對生產(chǎn)經(jīng)營單位的主要負責(zé)人給予撤職處分，對個人經(jīng)營的投資人處二萬元以上二十萬元以下的罰款。
If the act is not serious enough for assuming criminal liabilities, the major persons-in-charge of the production and business operation entity shall be given a punishment of demotion, and the investor of the individually run business be imposed a fine of not less than 20,000 yuan but not more than 200,000 yuan.
第八十一條 生產(chǎn)經(jīng)營單位的主要負責(zé)人未履行本法規(guī)定的安全生產(chǎn)管理職責(zé)的，責(zé)令限期改正；
Article 81 If the major person-in-charge of a production and business operation fails to perform his duty of administering production safety according to the provisions of the present law, he shall be ordered to mend up within a prescribed time period.
逾期未改正的，責(zé)令生產(chǎn)經(jīng)營單位停產(chǎn)停業(yè)整頓。
If he fails to mend up within the prescribed time period, the production and business operation entity shall be ordered to suspend production or business for rectifications.
生產(chǎn)經(jīng)營單位的主要負責(zé)人有前款違法行為，導(dǎo)致發(fā)生生產(chǎn)安全事故，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任；
If the major person-in-charge of a production and business operation entity commits any of the acts as mentioned in the preceding paragraph so that a production safety accident has resulted, and thus a crime has been constituted, the major person-in-charge shall assume criminal liabilities according to the relevant provisions of the Criminal Law.
尚不夠刑事處罰的，給予撤職處分或者處二萬元以上二十萬元以下的罰款。
If the acts are not serious enough for assuming criminal liabilities, he shall be given a punishment of demotion or be fined of not less than 20,000 yuan but not more than 200,000 yuan.
生產(chǎn)經(jīng)營單位的主要負責(zé)人依照前款規(guī)定受刑事處罰或者撤職處分的，自刑罰執(zhí)行完畢或者受處分之日起，五年內(nèi)不得擔(dān)任任何生產(chǎn)經(jīng)營單位的主要負責(zé)人。
If the major person-in-charge of a production and business operation entity assumes criminal liabilities or is punished by being removed from his positions according to the provisions of the preceding paragraph, he may not be the major person-in-charge of any production and business operation entity within five years starting from the day when the criminal penalty is executed or from the day when he is given the punishment.
第八十二條 生產(chǎn)經(jīng)營單位有下列行為之一的，責(zé)令限期改正；
Article 82 In any of the following circumstances, the production and business operation entity shall be ordered to mend up within a prescribed time periond.
逾期未改正的，責(zé)令停產(chǎn)停業(yè)整頓，可以并處二萬元以下的罰款：
If it fails to mend up within the prescribed time period, it shall be ordered to suspend production or business for rectifications, and may be fined not more than 20,000 yuan:
（一）未按照規(guī)定設(shè)立安全生產(chǎn)管理機構(gòu)或者配備安全生產(chǎn)管理人員的；
a. Failing to establish an organ for the administration of production safety or to arrange for persons to take charge of the administration of production safety;
（二）危險物品的生產(chǎn)、經(jīng)營、儲存單位以及礦山、建筑施工單位的主要負責(zé)人和安全生產(chǎn)管理人員未按照規(guī)定經(jīng)考核合格的；
b. The major persons-in-charge or the person in charge of production safety of an entity that produces, manages or stores hazardous substances or the mining or construction building entity fails to passed the examinations according to relevant provisions;
（三）未按照本法第二十一條、第二十二條的規(guī)定對從業(yè)人員進行安全生產(chǎn)教育和培訓(xùn)，或者未按照本法第三十六條的規(guī)定如實告知從業(yè)人員有關(guān)的安全生產(chǎn)事項的；
c. Failing to educate or train the workers according to the provisions of Articles 21 and 22 of the present law or failing to inform truthfully the workers of the production safety matters according to the provisions of Article 36 of the present law;
（四）特種作業(yè)人員未按照規(guī)定經(jīng)專門的安全作業(yè)培訓(xùn)并取得特種作業(yè)操作資格證書，上崗作業(yè)的。
d. The special operation staff members failing to receive specialized trainings in production safety and failing to obtain a qualifications certificate for the special operations according to the provisions yet still works at his position.
第八十三條 生產(chǎn)經(jīng)營單位有下列行為之一的，責(zé)令限期改正；
Article 83 In any of the following circumstances, the production and business operation entity shall be ordered to mend up within a prescribed time period.
逾期未改正的，責(zé)令停止建設(shè)或者停產(chǎn)停業(yè)整頓，可以并處五萬元以下的罰款；
If it fails to mend up within the prescribed time period, it shall be ordered to suspend construction or suspend production or business for rectifications, and may be fined not more than 50,000 yuan.
造成嚴重后果，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任：
If serious consequences have resulted and thus a crime has been constituted, the offenders shall be subject to criminal liabilities according to the relevant provisions of the Criminal Law.
（一）礦山建設(shè)項目或者用于生產(chǎn)、儲存危險物品的建設(shè)項目沒有安全設(shè)施設(shè)計或者安全設(shè)施設(shè)計未按照規(guī)定報經(jīng)有關(guān)部門審查同意的；
a. There is no design of safety facilities for a mining construction project or a construction project for the production or storage of hazardous substances, or the design of safety facilities has failed to be submitted to relevant departments according to relevant provisions for examination and approval;
（二）礦山建設(shè)項目或者用于生產(chǎn)、儲存危險物品的建設(shè)項目的施工單位未按照批準的安全設(shè)施設(shè)計施工的；
b. The construction entity of a mining project or a construction for the production or storage of hazardous substances fails to execute the construction according to the approved design of safety facilities;
（三）礦山建設(shè)項目或者用于生產(chǎn)、儲存危險物品的建設(shè)項目竣工投入生產(chǎn)或者使用前，安全設(shè)施未經(jīng)驗收合格的；
c. The safety facilities fail to pass the examinations for acceptance before a mining construction project or a construction project for the production or storage of hazardous substances is put into production or use;
（四）未在有較大危險因素的生產(chǎn)經(jīng)營場所和有關(guān)設(shè)施、設(shè)備上設(shè)置明顯的安全警示標志的；
d. Failing to place eye-catching safety warning marks on the sites of production and business operation or relevant facilities and equipments which are considerably dangerous;
（五）安全設(shè)備的安裝、使用、檢測、改造和報廢不符合國家標準或者行業(yè)標準的；
e. The installation, use, test, transformation or discarding safety facilities as useless is not in conformity with national standards or industrial standards;
（六）未對安全設(shè)備進行經(jīng)常性維護、保養(yǎng)和定期檢測的；
f. Failing to carry out regular maintenance or service or regular tests to the safety facilities;
（七）未為從業(yè)人員提供符合國家標準或者行業(yè)標準的勞動防護用品的；
g. Failing to provide labor protection products to the workers according to the national or industrial standards;
（八）特種設(shè)備以及危險物品的容器、運輸工具未經(jīng)取得專業(yè)資質(zhì)的機構(gòu)檢測、檢驗合格，取得安全使用證或者安全標志，投入使用的；
h. A special equipment or a container or transportation for hazardous substances is put into use before passing the detection and test of the eligible institutions and obtaining a certificate for safety use or a safety label;
（九）使用國家明令淘汰、禁止使用的危及生產(chǎn)安全的工藝、設(shè)備的。
i. Using any of the techniques or equipments that endanger production safety and that have been explicitly announced to be eliminated or to be prohibited from use.
第八十四條 未經(jīng)依法批準，擅自生產(chǎn)、經(jīng)營、儲存危險物品的，責(zé)令停止違法行為或者予以關(guān)閉，沒收違法所得，違法所得十萬元以上的，并處違法所得一倍以上五倍以下的罰款，沒有違法所得或者違法所得不足十萬元的，單處或者并處二萬元以上十萬元以下的罰款；
Article 84 Any one who unlawfully produces, manages or stores any hazardous product without approval shall be ordered to terminate the illegal act or to close down with its illegal proceeds be confiscated and imposed upon a fine of not less than one time but not more than five times the illegal proceeds if such proceeds are more than 100,000 yuan or be simply imposed upon a fine of not less than 20,000 yuan but not more than 100,000 yuan if there are no illegal proceeds or if the illegal proceeds are less than 100,000 yuan.
造成嚴重后果，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任。
If serious consequences have resulted and a crime has been constituted, the offenders shall assume criminal liabilities according to the relevant provisions of the Criminal Law.
第八十五條 生產(chǎn)經(jīng)營單位有下列行為之一的，責(zé)令限期改正；逾期未改正的，責(zé)令停產(chǎn)停業(yè)整頓，可以并處二萬元以上十萬元以下的罰款；
Article 85 In any of the following circumstances, the production and business operation entity shall be ordered to mend up within a prescribed time period. If it fails to mend up within the prescribed time period, it shall be ordered to suspend production or business for rectifications and may be imposed upon a fine of not less than 20,000 yuan but not more than 100,000 yuan.
造成嚴重后果，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任：
If serious consequences have resulted and a crime has been constituted, the offenders shall be subject to criminal liabilities according to the relevant provisions of the Criminal Law.
（一）生產(chǎn)、經(jīng)營、儲存、使用危險物品，未建立專門安全管理制度、未采取可靠的安全措施或者不接受有關(guān)主管部門依法實施的監(jiān)督管理的；
a. Failing to establish special safety administration systems or failing to take effective safety measures or refusing to accept the lawful supervision and administration of the administrative departments for the production, management, storage or use of hazardous substances;
（二）對重大危險源未登記建檔，或者未進行評估、監(jiān)控，或者未制定應(yīng)急預(yù)案的；
b. Failing to create archivist files or failing to make appraisals or monitors or failing to make emergence plans for important sources of danger;
（三）進行爆破、吊裝等危險作業(yè)，未安排專門管理人員進行現(xiàn)場安全管理的。
c. Failing to arrange for specialized administrative personnel to conduct on-spot administration of production safety in the dangerous operations including explosions and hoistings, etc.
第八十六條 生產(chǎn)經(jīng)營單位將生產(chǎn)經(jīng)營項目、場所、設(shè)備發(fā)包或者出租給不具備安全生產(chǎn)條件或者相應(yīng)資質(zhì)的單位或者個人的，責(zé)令限期改正，沒收違法所得；違法所得五萬元以上的，并處違法所得一倍以上五倍以下的罰款；
Article 86 Any production and business operation entity who contracts or leases any production and business operation project, site or equipment to any entity or individual without the conditions for production safety or without corresponding qualifications shall be ordered to mend up within a prescribed time period and the illegal proceeds thereof shall be confiscated and, at the same time be fined not less than one time but not more than five times the illegal proceeds if such proceeds are more than 50,000 yuan.
沒有違法所得或者違法所得不足五萬元的，單處或者并處一萬元以上五萬元以下的罰款；
or be simply or concurrently imposed upon a fine of not if there are no illegal proceeds or if such proceeds are less than 50,000 yuan.
導(dǎo)致發(fā)生生產(chǎn)安全事故給他人造成損害的，與承包方、承租方承擔(dān)連帶賠償責(zé)任。
If damages have been caused to other people due to a production safety accident, it shall take several and joint liabilities with the contractor or the lessee.
生產(chǎn)經(jīng)營單位未與承包單位、承租單位簽訂專門的安全生產(chǎn)管理協(xié)議或者未在承包合同、租賃合同中明確各自的安全生產(chǎn)管理職責(zé)，或者未對承包單位、承租單位的安全生產(chǎn)統(tǒng)一協(xié)調(diào)、管理的，責(zé)令限期改正；
Any production and business operation who fails to enter into a production safety administration agreement with the contractor entity or lessee or failing to specify the duties and functions of production safety administration of the parties concerned in the contracting agreement or leasehold contract or failing to conduct unified coordination and administration of production safety over the contracting entity or lessee shall be ordered to mend up within a prescribed time period.
逾期未改正的，責(zé)令停產(chǎn)停業(yè)整頓。
If it fails to mend up within the prescribed time period, it shall be ordered to suspend production or business for rectifications.
第八十七條 兩個以上生產(chǎn)經(jīng)營單位在同一作業(yè)區(qū)域內(nèi)進行可能危及對方安全生產(chǎn)的生產(chǎn)經(jīng)營活動，未簽訂安全生產(chǎn)管理協(xié)議或者未指定專職安全生產(chǎn)管理人員進行安全檢查與協(xié)調(diào)的，責(zé)令限期改正；逾期未改正的，責(zé)令停產(chǎn)停業(yè)。
Article 87 Where two or more production and business operation entities operate within a same area that may endanger the safe production of the other party or fail to enter into any agreement for the administration of production safety or fail to designate full-time administrative persons of production safety to conduct safety inspections and coordination, they shall be ordered to mend up within a prescribed time period. If they fail to mend up within the prescribed time period, they shall be ordered to terminate production and business operation.
第八十八條 生產(chǎn)經(jīng)營單位有下列行為之一的，責(zé)令限期改正；逾期未改正的，責(zé)令停產(chǎn)停業(yè)整頓；
Article 88 In any of the following circumstances, a production and business operation entity shall be ordered to mend up within a prescribed time period. If it fails to mend up within the prescribed time period, it shall be ordered to suspend production and business for rectifications.
造成嚴重后果，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任：
If serious consequences have resulted and a crime has been constituted, the offenders shall be subject to criminal liabilities according to the relevant provisions of the Criminal Law.
（一）生產(chǎn)、經(jīng)營、儲存、使用危險物品的車間、商店、倉庫與員工宿舍在同一座建筑內(nèi)，或者與員工宿舍的距離不符合安全要求的；
a. The workshop, store or warehouse where hazardous substances are produced, managed, stored or used is in a same building as the dormitory of the employees, or the distance between them and the employees' dormitory does not satisfy the safety requirements;
（二）生產(chǎn)經(jīng)營場所和員工宿舍未設(shè)有符合緊急疏散需要、標志明顯、保持暢通的出口，或者封閉、堵塞生產(chǎn)經(jīng)營場所或者員工宿舍出口的。
b. In the production and business operation site and the employees' dormitories there is no exit which meets the requirements of emergency dispersal and which is eye-catching and unblocked, or the exit to the sites of production and business operation or the employees' dormitories is closed or blocked.
第八十九條 生產(chǎn)經(jīng)營單位與從業(yè)人員訂立協(xié)議，免除或者減輕其對從業(yè)人員因生產(chǎn)安全事故傷亡依法應(yīng)承擔(dān)的責(zé)任的，該協(xié)議無效；對生產(chǎn)經(jīng)營單位的主要負責(zé)人、個人經(jīng)營的投資人處二萬元以上十萬元以下的罰款。
Article 89 Where any production and business operation entity enters into any agreement with any of the employees to exempt or mitigate the liabilities that it has to undertake due to casualties of employees in production safety accidents, such agreements shall be invalid, and the major person-in-charge of the production and business operation entity or the investor of the individually run business shall be fined not less than 20,000 yuan but not more than 200,000 yuan.
第九十條 生產(chǎn)經(jīng)營單位的從業(yè)人員不服從管理，違反安全生產(chǎn)規(guī)章制度或者操作規(guī)程的，由生產(chǎn)經(jīng)營單位給予批評教育，依照有關(guān)規(guī)章制度給予處分；
Article 90 Any worker of a production and business operation entity who does not obey the administration of the entity or violates the rules and regulations concerning production safety or breaches the operational rules shall be criticized and educated by the production and business operation entity, and shall be given a disciplinary punishment.
造成重大事故，構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任。
If any serious accident has resulted and thus a crime has been constituted, the offender shall be subject to criminal liabilities according to the relevant provisions of the Criminal Law.
第九十一條 生產(chǎn)經(jīng)營單位主要負責(zé)人在本單位發(fā)生重大生產(chǎn)安全事故時，不立即組織搶救或者在事故調(diào)查處理期間擅離職守或者逃匿的，給予降職、撤職的處分，對逃匿的處十五日以下拘留；構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任。
Article 91 Where the major person-in-charge of any production and business operation entity fails to organize rescues immediately when any serious production safety accident occurs to the entity or leaves his position without permission or escapes and hides during the investigation and handling of the accident, he shall be punished by being demoted or removed from his position, and be held in custody for not more than 15 days if he has escaped and hid. If any crime has been constituted, he shall be subject to assuming criminal liabilities according to the relevant provisions of the Criminal Law.
生產(chǎn)經(jīng)營單位主要負責(zé)人對生產(chǎn)安全事故隱瞞不報、謊報或者拖延不報的，依照前款規(guī)定處罰。
The major person-in-charge of any production and business operation entity who conceals any production safety accident or submits deceitful reports or delays reports shall be punished according to the provisions as mentioned in the preceding paragraph.
第九十二條 有關(guān)地方人民政府、負有安全生產(chǎn)監(jiān)督管理職責(zé)的部門，對生產(chǎn)安全事故隱瞞不報、謊報或者拖延不報的，對直接負責(zé)的主管人員和其他直接責(zé)任人員依法給予行政處分；構(gòu)成犯罪的，依照刑法有關(guān)規(guī)定追究刑事責(zé)任。
Article 92 Where the relevant local people's government or the department responsible for the supervision and administration of production safety conceals any production safety accident or submits deceitful reports or delays reports, the major person-in-charge or other persons who are held to be directly responsible shall be given an administrative punishment according to law. If any crime has been constituted, the offenders shall be subject to assuming criminal liabilities according to the relevant provisions of the Criminal Law.
第九十三條 生產(chǎn)經(jīng)營單位不具備本法和其他有關(guān)法律、行政法規(guī)和國家標準或者行業(yè)標準規(guī)定的安全生產(chǎn)條件，經(jīng)停產(chǎn)停業(yè)整頓仍不具備安全生產(chǎn)條件的，予以關(guān)閉；有關(guān)部門應(yīng)當(dāng)依法吊銷其有關(guān)證照。
Article 93 If a production and business operation entity does not meet the requirements as provided by the present law or other relevant laws or administrative regulations or national or industrial standards and still does not meet the requirements for production safety after rectifications during the period of time when it production or business is suspended, it shall be closed down, and the relevant certificates or licenses thereof shall be canceled by the relevant authorities.
第九十四條 本法規(guī)定的行政處罰，由負責(zé)安全生產(chǎn)監(jiān)督管理的部門決定；予以關(guān)閉的行政處罰由負責(zé)安全生產(chǎn)監(jiān)督管理的部門報請縣級以上人民政府按照國務(wù)院規(guī)定的權(quán)限決定；
Article 94 The administrative punishments as mentioned in the present law shall be decided by the department responsible for the supervision and administration of production safety. The administrative punishment of closing down shall be submitted by the department responsible for the supervision and administration of production safety to the people's government on the county level or above for decision according to their division of power as provided by the State Council.
給予拘留的行政處罰由公安機關(guān)依照治安管理處罰條例的規(guī)定決定。有關(guān)法律、行政法規(guī)對行政處罰的決定機關(guān)另有規(guī)定的，依照其規(guī)定。
The administrative punishment of keeping in custody shall be decided by the public security organ according to the provisions of the Regulation on the Punishments for the Administration of Public Security. If there are different provisions in the relevant laws or administrative regulations concerning administrative punishments, such provisions shall be applicable.
第九十五條 生產(chǎn)經(jīng)營單位發(fā)生生產(chǎn)安全事故造成人員傷亡、他人財產(chǎn)損失的，應(yīng)當(dāng)依法承擔(dān)賠償責(zé)任；
Article 95 If personal casualties or property losses have been caused to other people by any production safety accident of any production and business operation entity, the entity shall be responsible for making compensations.
拒不承擔(dān)或者其負責(zé)人逃匿的，由人民法院依法強制執(zhí)行。
If the entity refuses to make compensations or the persons-in-charge escape and hide, the compensation shall be enforced by the people's court according to law.
生產(chǎn)安全事故的責(zé)任人未依法承擔(dān)賠償責(zé)任，經(jīng)人民法院依法采取執(zhí)行措施后，仍不能對受害人給予足額賠償?shù)�，�?yīng)當(dāng)繼續(xù)履行賠償義務(wù)；
If the persons who are held to be responsible for a production safety accident fail to make compensations and the losses of the victims still cannot be compensated in full amount after the people's court has taken enforcement measures, the persons who are responsible shall continue to undertake their obligations of compensations.
受害人發(fā)現(xiàn)責(zé)任人有其他財產(chǎn)的，可以隨時請求人民法院執(zhí)行。
If the victims find that the persons who are responsible have other assets, they may plead the people's court at any time for enforcement.
第七章 附 則
Chapter VII Supplementary Provisions
第九十六條 本法下列用語的含義：
Article 96 The terms as mentioned in the present law defined as follows:
危險物品，是指易燃易爆物品、危險化學(xué)品、放射性物品等能夠危及人身安全和財產(chǎn)安全的物品。
"Hazardous substance" refers to any substance that may endanger the safety of a person or property, including flammable and explosive substances, hazardous chemicals, radioactive substances, etc.
重大危險源，是指長期地或者臨時地生產(chǎn)、搬運、使用或者儲存危險物品，且危險物品的數(shù)量等于或者超過臨界量的單元（包括場所和設(shè)施）。
"Important sources of danger" refers to the units (including sites and facilities) where hazardous substances are produced, carried, used or stored for a long term or temporarily and the quantity of the hazardous substances is equal to or has surpassed the threshold quantity.
第九十七條 本法自2002年11月1日起施行
Article 97 The present law shall become effective as of November 1, 2002.
